Terms and Conditions for Monitors

  • General Provisions

    • The Terms and Conditions for Monitors (hereafter, the Terms and Conditions) stipulates the contract terms between Hankyu Hanshin Properties Corp. (hereafter, “the Company”) and the persons that the Company has approved to be registered as “product planning project members” and “monitors of residences” (hereafter, “the Monitors”,) in the monitoring activities (hereafter, “the Activities”) carried out by the Company.
    • The Activities in the Terms and Conditions refers to questionnaires carried out by interviews with the Monitors (hereafter, “Monitor Meetings”) at a place specified by the Company or online using an internet conference system, by email or post, or by other methods specified by the Company for the purpose of receiving feedback on the Company’s product planning.
    • If the Company makes an amendment to the Terms and Conditions, the Monitors will be notified in advance on the Company’s website and by other means of the contents of the Terms and Conditions after amendment and the date of the amendment. The Terms and Conditions after amendment will apply to the Monitors from the date of the amendment.
    • If there are any provisions on the handling of personal information and other provisions that differ from the provisions stipulated in the Terms and Conditions, the provisions of the Terms and Conditions will take priority in application.
  • Qualifications of the Monitors

    • The Monitors in the Terms and Conditions have been recruited in accordance with the format and within the period of time specified by the Company, upon agreement of the Terms and Conditions. The people the Company has approved to be registered as monitors of residences are individuals and their family members that are members of the Geo Club or Hankyu Hanshin Owners Club, which are member organizations for people who are considering purchasing one of the Company’s newly built condominiums for sale.
    • Individuals and their family members who wish to become registered monitors are to be aged 20 years and above.
    • Individuals and their family members who wish to become registered monitors do not work for an advertising agency, or do not work in a company that is involved in real estate, marketing, or market surveys.
    • Individuals and their family members who wish to become registered monitors are able to cooperate in product planning Monitor Meetings and surveys, etc. These people agree in advance to photos and video footage being taken at Monitor Meetings, etc., that show their figure and/or face, and the publishing of those photos and contents of statements in the Company’s website and newsletter, etc.
  • Duty of Confidentiality of the Monitors

    • Monitors shall not leak to third parties by any means or methods whatsoever the information and contents obtained through the Activities. The Duty of Confidentiality shall not be extinguished even after the conclusion of the monitoring period.
  • Prohibited Actions of Monitors

    • The Monitors must not engage in any of the actions, or actions that may lead to such actions, that are listed below.
      • Actions that go against public order and morals.
      • Actions that violate legislation, ordinances, and other laws and regulations, etc.
      • Actions that infringe the copyrights of the Company, other Monitors, and third parties.
      • Actions that defame and slander the Company, other Monitors, and third parties.
      • Actions that are detrimental to the Company, other Monitors, and third parties.
      • Campaigning or similar actions, and actions that violate laws and regulations such as the Public Offices Election Act.
      • Providing false registrations, and/or false survey responses.
      • Actions that interfere with the operation of the Activities.
      • Sales activities that are not approved by the Company.
      • Taking photos during the Activities (excluding when approval is given by the Company).
      • Other actions that the Company determines to be inappropriate.
  • Withdrawal of Monitor Registration

    • If an individual withdraws their monitor registration, notification is to be provided by the methods specified by the Company.
    • All rights held by the Monitor will extinguish at the time of their withdrawal of monitor registration. The Monitor is still subject to the Duty of Confidentiality, even after their withdrawal of monitor registration.
  • Cancellation of Monitor Registration

    • Even after the Company has approved and registered an individual as a monitor, upon notification to the Monitor by the Company’s prescribed methods, the Company can cancel an individual’s monitor registration if the Monitor engages in any of the actions that fall under the Prohibited Actions of Monitors, or acts in violation of the Terms and Conditions, falsifies registration, violates the Duty of Confidentiality, etc., and the Company determines they are not appropriate as a Monitor. In the event of cancellation, all rights held by the Monitor will extinguish. The Monitor is still subject to the Duty of Confidentiality, even after the cancellation of monitor registration.
    • Monitor registration will be automatically canceled at the completion of the registration period listed in the recruitment information. In that case, the Company will not send a notice of cancellation to the Monitor. The Monitor is still subject to the Duty of Confidentiality, even after the cancellation of monitor registration.
  • Compensation for Damages

    • The Company can claim compensation for damages from a Monitor if the Monitor violates the Terms and Conditions, and causes damage to the Company or third parties.
  • Changes to and Temporary Interruption, Suspension, and Discontinuation of the Activities

    • The Company may change, interrupt, suspend, or discontinue part or all of the Activities at any time and without any notification whatsoever, and regardless of the approval or non-approval of the Monitors.
    • The Company assumes no responsibility whatsoever for any detriment or damages to the Monitors that arise from changes or temporary interruption.
  • Registration Information of Monitors

    • The information provided by the Monitors at the time of monitor registration (hereafter, “Registration Information”) is owned by the Company.
    • Any false declarations made in relation to all information in the application for monitor registration will be disregarded.
    • If a Monitor’s address, email address, or other Registration Information changes, the Monitor will promptly notify the Company, and complete the Company’s prescribed procedures for changes.
    • If deemed as necessary, the Company will confirm the contents of the Registration Information of the Monitors by phone call, email, or other methods.
  • Copyrights of the Monitors’ Responses

    • The copyrights (including the rights stipulated in Articles 27 and 28 of the Copyright Act) of the contents of responses including statements, creations, submitted items and other items recorded in the survey process of Monitors in the Activities and all other rights belong to the Company, and the Monitors shall not exercise the moral right of an author against the Company. The Company can freely select, modify, and edit the contents of the responses.
    • The Company can use the contents of the Monitors’ responses in its businesses, and disclose the contents without the consent of the Monitors themselves. The handling of Registration Information is stipulated in Personal Information.
  • Personal Information

    • The Monitors agree to the Company’s Privacy Policy and participate in the Activities.
  • Court of Exclusive Jurisdiction

    • If any disputes arise between the Company and the Monitors in relation to the Terms and Conditions, the first Court of Exclusive Jurisdiction will be the Osaka District Court.
  • Matters for Consultation

    • The matters not stipulated in these Terms and Conditions will be settled amicably by mutual consultation, in accordance with the principle of good faith and integrity.
